Administrative and Public Law

The Administrative and Public Law division at KLA provides support to clients involved in regulated sectors such as sanitation, life sciences, and agribusiness, as well as their interactions with public entities, including bidding processes and exemption and waiver procedures.

The team also handles administrative litigation across all government levels, with an experienced team adept at addressing infrastructure matters, government investigations, public service concessions, and Public-Private Partnerships (PPPs).

SERVICES

Public Procurement and Contracts

  • Practice in public works contracts and engineering services
  • Experience with integrated and semi-integrated contracting under Law No. 14,133/2021
  • Mapping of structures for participation in accordance with the rules of each bid
  • Drafting of requests for clarification, administrative appeals, and challenges
  • Advisory services in preparatory acts prior to contract signing
  • Management and planning of contract execution

 

Administrative and Judicial Litigation

  • Litigation related to public procurement and contracts
  • Actions involving administrative misconduct and matters related to sanctioning law
  • Judicial and arbitral proceedings involving the economic-financial rebalancing of public contracts
  • Litigation related to the use of highway right-of-way by concessionaires
  • Administrative proceedings before regulatory agencies

 

Infrastructure

  • Practice in regulated sectors such as sanitation, highways, social infrastructure, and ports
  • Management of public contracts, mapping of legal and regulatory risks
  • Experience in interfacing with ARTESP and ANTT on regulatory and transactional matters
  • Formation of JVs, consortia, SPVs, and strategic partnerships regarding infrastructure assets
  • Practice in negotiations with Granting Authorities and regulatory agencies
